Privacy Rights

1Australia

Subject to applicable law, you may request:

• access to personal information we hold about you;
• correction of information that is inaccurate, out of date, incomplete, irrelevant or misleading; and
• information about how we handle your personal information.

You may also make a privacy complaint to us.

If you are not satisfied with our response, you may have the right to complain to the Office of the Australian Information Commissioner (OAIC) or another applicable privacy or health-privacy regulator.

2European Economic Area and European Union

Where the GDPR applies to our processing of your personal data, you may have rights including:

• access;
• correction;
• erasure;
• restriction of processing;
• data portability;
• objection to certain processing;
• withdrawal of consent where processing relies on consent; and
• the right to lodge a complaint with an applicable supervisory authority.

These rights may be subject to legal exceptions.

3United Kingdom

Where UK data-protection law applies, you may have rights including:

• access;
• rectification;
• erasure;
• restriction;
• portability;
• objection;
• withdrawal of consent where applicable; and
• rights relating to certain solely automated decisions.

You may also have the right to complain to the UK Information Commissioner’s Office.

4United States

Privacy rights vary between US states.

Where an applicable state privacy law gives you rights, those may include rights to:

• know or access personal information;
• correct inaccurate information;
• delete certain information;
• obtain a portable copy of certain information;
• withdraw consent to certain processing; or
• opt out of certain types of sale, sharing or targeted advertising where applicable.

Coach Anaya does not sell identifiable health information.

Additional protections apply to consumer health data in certain states.

Washington

Washington residents and certain people whose consumer health data is collected in Washington may have additional rights under the Washington My Health My Data Act. See the Washington Consumer Health Data Privacy Policy.

Nevada

Nevada consumers may have additional rights concerning consumer health data under Nevada law. See the Nevada Consumer Health Data Privacy Policy.

5Canada

Where applicable Canadian privacy law applies, you may have rights to request access to personal information, request correction of inaccurate information, withdraw consent in appropriate circumstances and make a complaint to the applicable privacy regulator.

6New Zealand

Where New Zealand privacy law applies, you may have rights to request access to and correction of personal information and to make a complaint to the applicable privacy authority.

7Brazil

Where Brazil’s data-protection law applies, you may have rights relating to confirmation of processing, access, correction, deletion or anonymisation in applicable circumstances, portability, information about sharing and withdrawal of consent where relevant.

8Other jurisdictions

Other countries and regions may provide additional privacy rights.

We will assess and respond to your request in accordance with applicable law.

9Account deletion

You may request deletion of your Coach Anaya account through our account-deletion process.

Deletion rights may be subject to information that we are required or permitted to retain under health-record, taxation, transaction, security, dispute-resolution or other applicable laws.

10Withdrawing consent

Where we rely on your consent for a particular activity, you may withdraw that consent prospectively.

Withdrawal does not make prior lawful processing unlawful and may mean that we can no longer provide a feature that depends on the information concerned.

You may also change certain permissions, notification preferences and feature settings within Coach Anaya or through your device settings.

11Authorised representatives

Where applicable law permits, you may use an authorised representative to make a request for you.

We may require reasonable evidence of their authority and may need to verify your identity directly where permitted.

12No retaliation

We will not unlawfully discriminate against you for exercising a privacy right available under applicable law.
